What counts as non-disclosure?
Any answer on your policy that no longer reflects reality. The usual suspects:
- An out-of-date job title after a role change
- The wrong address or overnight parking location after a move
- Modifications that were never declared
- Annual mileage well below what you actually drive
- Points, claims or convictions that weren't mentioned
Does it have to be deliberate?
No. Under the Consumer Insurance (Disclosure and Representations) Act 2012, what happens next depends on whether the misrepresentation was careless or deliberate — but even an honest mistake can lead to a reduced settlement and, in some cases, a rejected claim. Insurers routinely check the details you gave at the point of a claim, not just at the point of sale.
How do I avoid it?
Re-read your statement of fact (sometimes called a proposal confirmation) each year at renewal and check every answer still holds true. During the policy year, tell your insurer about changes as they happen — a new job, a house move, a modification, points on your licence. Most insurers let you update details mid-term.
